PRIVACY POLICY

AIhelpYou — AIhelp Ecosystem

Welcome to AIhelpYou, the automatic emergency application of the AIhelp system. Your privacy and the security of your data are our highest priority.

The AIhelp ecosystem is made up of three integrated components:
AIhelpYou — the main application for Android smartphones. It handles voice recognition of emergency keywords, the sending of help notifications (SMS, Telegram, calls) and the configuration of the entire system.
AIhelpWatch — the companion application for smartwatches. It lets you trigger an emergency directly from the smartwatch through a dedicated virtual button or through a voice command with a predefined keyword, in 12 languages.
AIhelpButton (optional) — an optional physical device. It lets you trigger an emergency through a physical button or a voice command, communicating with AIhelpYou via Bluetooth Low Energy (BLE).

This policy applies to all three components of the system.

1. Data Controller
The data controller is:

2. Data Processed and Methods of Collection
AIhelpYou operates according to the data minimization principle (Art. 5(1)(c) GDPR). The app does not collect or store users' personal data, including phone numbers or other identifiers, on the Developer's servers.

2A. Sensitive Data Stored Locally
The following information is kept exclusively on the user's device, in encrypted form:
Emergency contacts (1-2 phone numbers)
Telegram Chat IDs (1-2 identifiers)
Telegram recipient's phone number (used only, at your request, to send them the link to connect to the service)
Nickname / identifying name (shown in the alert messages sent to your contacts)
Custom voice keywords (1-3 keywords)
Configuration preferences (including the live-location duration and the enabled actions)
Temporary technical logs
Service status (active/inactive)

All of this data is never collected, transmitted or shared with the Developer.

2B. Data Transfer Triggered by an Emergency
Upon recognition of a voice keyword, pressing the emergency button in the app, the physical AIhelpButton, or the GO button on AIhelpWatch, the app may:
Send an SMS with instant geolocation to the configured contacts
Transmit Telegram messages with real-time location, for a duration set by the user from 1 minute up to 24 hours (30 minutes if not specified)
Start automatic phone calls to the configured contacts (the second call is made, by default, 45 seconds after the first)

GPS coordinates are not stored or collected by the Developer or by third parties. They are generated in real time and transmitted immediately without storage.

The App does not collect, store or transmit any health data, including vital signs, diagnoses or medical records. The microphone is used exclusively for the local detection of predefined emergency keywords, without audio recording.

2C. Technical Data
Anonymous, aggregated data may be collected through standard Google Play tools for the sole purpose of improving the app's reliability and stability.

2D. Data Relating to Companion Devices (AIhelpWatch and AIhelpButton)
Companion devices communicate with AIhelpYou exclusively via Bluetooth Low Energy (BLE) and/or the Google Wearable Data Layer API.

BLE Communication — AIhelpWatch and AIhelpButton
The Bluetooth signal transmitted by the companion devices contains a BLE service identifier (UUID) used to trigger the emergency. The app does not use or associate these signals with the user's personal data. No personal data, GPS coordinates, audio, phone numbers or other identifiers are transmitted via BLE.

Google Wearable Data Layer API — AIhelpWatch
AIhelpYou synchronizes with AIhelpWatch exclusively some information necessary for the operation of the service, in particular:
* the language currently set in the app on the smartphone, for the sole purpose of showing on the smartwatch the default voice command ("Aiutami") in the correct language;
* the operational status of the service (active/inactive);
* the active emergency keywords (predefined and any custom ones set by the user), for the sole purpose of enabling voice recognition of the emergency directly from the smartwatch.
This data transits through the Google Play Services infrastructure (Wear OS Data Layer API), is subject to Google's Privacy Policy, and is not transmitted to the Developer or to third parties. No audio content is transmitted to the smartwatch through this mechanism.
Emergency Telegram messages temporarily transit through Telegram's servers, subject to Telegram's privacy and security policies.

3. Permissions Requested by the App
AIhelpYou requests the following system permissions to function correctly:
Microphone: The microphone is used by AIhelpYou for the continuous detection of emergency keywords through a service running both in the foreground and in the background, even with the screen off, without audio recording or storage.
Precise location (GPS): Acquisition of GPS coordinates exclusively at the moment the emergency is triggered.
SMS and Calls: Autonomous and automatic sending of SMS and/or starting of calls to the configured emergency contacts. In addition, during setup and at your explicit request, SMS may be used to send the Telegram recipient a link to connect (pair) to the service: your carrier's standard SMS charges may apply.
Display over other apps: Required to ensure the continuous (24/7) maintenance of voice detection.
Notifications: For operational updates of the app on Android 13 and later.
Background usage: Allows the app to operate even when it is not in the foreground.
Do Not Disturb access: Ensures immediate handling of emergencies even in silent mode.
Bluetooth (BLUETOOTH, BLUETOOTH_SCAN, BLUETOOTH_CONNECT): Required for communication with the companion devices AIhelpButton (Nicla Voice) and AIhelpWatch (Smartwatch). Used exclusively to receive the emergency activation signal. No identifiable personal data is transmitted via Bluetooth.
Full-screen notifications (USE_FULL_SCREEN_INTENT): Allows the app to open automatically on the device's screen when an emergency is triggered, even when the screen is locked.
Auto-start and battery management: Required to ensure the app stays active in the background on devices with aggressive power-saving systems (Xiaomi, Samsung, Huawei, Motorola, etc.).

4. Legal Basis for Processing (Art. 6 GDPR)
The processing of personal data is based on the following legal bases:
Performance of a contract (Art. 6(1)(b) GDPR): Processing is necessary for the performance of the service requested by the user.
Consent (Art. 6(1)(a) GDPR): The user has given their explicit consent to the collection and processing of data for the stated purposes.
Legitimate interest (Art. 6(1)(f) GDPR): Processing is necessary to pursue the legitimate interest in the user's personal safety.

5. Sharing with Third Parties
The Developer shares data exclusively at the moment the emergency is triggered (or, for the pairing link, at the user's request during setup) with the following third parties:
Telecommunications operators: For sending the emergency SMS and any SMS containing the Telegram connection link.
Telegram service: For transmitting the emergency messages with geolocation.
Google Wearable Data Layer API / Google Play Services: For synchronizing the operational status, the language and the active keywords with AIhelpWatch. The synchronized data is not transmitted to the Developer or stored on the Developer's servers.

The Developer does not have access to the transmitted data, does not store it, and is not responsible for its processing by these third-party services. The processing of data by such Services is governed by their respective privacy policies.

6. Data Retention
Local data (keywords, contacts, nickname, configuration): Kept indefinitely until the app is uninstalled or manually deleted through Android Settings.
GPS data: Not stored by the Developer. The retention period is zero.
Audio data: Never recorded, stored or transmitted. The retention period is zero.
Anonymous technical data: Subject to Google's retention policies.
BLE data: Not stored. The BLE signal is volatile and contains no personal data.
The app does not collect or transmit personal data to the Developer. Data such as emergency contacts, Telegram Chat IDs and nickname is stored exclusively on the user's device.

7. User Rights (GDPR Arts. 15–22)
The user has the right to:
Access their processed personal data
Obtain the rectification of inaccurate data
Request the deletion of their data
Object to processing or request its restriction
Receive their data in a portable format

Since the vast majority of the data is stored locally on the user's device, the rights that can be exercised against the Developer are limited to anonymous technical data only.

Deletion of local data is carried out by uninstalling the app or by manual deletion through Android Settings › Apps › AIhelpYou › Storage.

8. Minors
The App is not intended for children under 14. Use is permitted exclusively to adult users (18+) or, for minors aged between 14 and 18, under the explicit supervision and responsibility of a parent or legal guardian.

9. Policy Updates
This Privacy Policy may be updated. The latest version will always be available within the App and on the official website. Continued use of the App following changes constitutes acceptance of them.

Sensitive data (keywords, contacts) is processed exclusively on the device. Location and audio data are used exclusively for the critical emergency function and are never collected or stored by the Developer.
